REPLACEMENT AND CORRECTION Sample Clauses

The REPLACEMENT AND CORRECTION clause establishes the obligation and process for correcting or replacing goods, services, or deliverables that are found to be defective, non-conforming, or otherwise unsatisfactory. Typically, this clause requires the supplier or service provider to promptly address any issues identified by the recipient, either by repairing, correcting, or substituting the affected items at no additional cost. REPLACEMENT AND CORRECTION. A. Construction Manager shall promptly replace or correct all work found not be in compliance with the requirements of the Contract Documents and the requirements of any public authority having jurisdiction so as not to delay the Work or the Work of other vendors, suppliers, contractors or subcontractors regardless of how such failure to comply may be revealed. Replacement and correction shall be expedited as required to maintain interim Contract completion dates and the full completion date. B. Project Manager may require additional testing and inspection of Work previously found not to be in compliance until such Work has been properly replaced or corrected. Such additional testing and inspection shall be at Construction Manager’s expense.
