Common use of Replacement Documentation Clause in Contracts

Replacement Documentation. Upon receipt of an affidavit of an officer of Administrative Agent or any Lender as to the loss, theft, destruction or mutilation of any of the Notes or any other security document which is not of public record, and, in the case of any such loss, theft, destruction or mutilation, upon surrender and cancellation of such Note or other security document and receipt of an agreement of indemnification satisfactory to Borrower executed by Administrative Agent or the applicable Lender, Borrower will issue, in lieu thereof, a replacement Note or other security document in the same principal amount thereof and otherwise of like tenor.

Replacement Documentation. Upon receipt of an affidavit of an officer of Administrative Agent or any Lender as to the loss, theft, destruction or mutilation of this Agreement, any of the Notes other Loan Document, or any other security document which is not of public record, andor an affidavit from any Lender as to the occurrence of the same to such Lender’s Note, in and customary (unsecured, unbonded) indemnification from the case of any such loss, theft, destruction or mutilation, upon surrender and cancellation of such Note or other security document and receipt of an agreement of indemnification satisfactory to Borrower executed by Administrative Agent or the applicable Lender, as applicable, reasonably satisfactory to the Borrower, the Borrower will issue, in lieu thereof, a replacement Note Note, Agreement, Loan Document or other security document in the same principal amount thereof and otherwise of like tenor.
