Common use of Replacement Interest Rate Cap Agreement Clause in Contracts

Replacement Interest Rate Cap Agreement. If, in connection with Mezzanine Borrower’s exercise of any extension option pursuant to Section 5 of the Mezzanine Note, Mezzanine Borrower delivers a Replacement Interest Rate Cap Agreement (Fourth Mezzanine), all the provisions of this Article IX applicable to the Interest Rate Cap Agreement (Fourth Mezzanine) delivered on the Closing Date shall be applicable to the Replacement Interest Rate Cap Agreement (Fourth Mezzanine).

Replacement Interest Rate Cap Agreement. If, in connection with Mezzanine Borrower’s exercise of any extension option pursuant to Section 5 of the Mezzanine Note, Mezzanine Borrower delivers a Replacement Interest Rate Cap Agreement (Fourth First Mezzanine), all the provisions of this Article IX applicable to the Interest Rate Cap Agreement (Fourth First Mezzanine) delivered on the Closing Date shall be applicable to the Replacement Interest Rate Cap Agreement (Fourth First Mezzanine).

If, in connection with Mezzanine Borrower’s exercise of any extension option pursuant to Section 5 of the Mezzanine Note, Mezzanine Borrower delivers a Replacement Interest Rate Cap Agreement (Fourth Third Mezzanine), all the provisions of this Article IX applicable to the Interest Rate Cap Agreement (Fourth Third Mezzanine) delivered on the Closing Date shall be applicable to the Replacement Interest Rate Cap Agreement (Fourth Third Mezzanine).

If, in connection with Mezzanine Borrower’s 's exercise of any extension option the Extension Option pursuant to Section 5 of the Mezzanine Note, Mezzanine Borrower delivers a Replacement Interest Rate Cap Agreement (Fourth Mezzanine)Agreement, all the provisions of this Article IX applicable to the Interest Rate Cap Agreement (Fourth Mezzanine) delivered on the Closing Date shall be applicable to the Replacement Interest Rate Cap Agreement (Fourth Mezzanine)as of the date that was the Initial Maturity Date.
