Common use of Replacement of Fixtures Clause in Contracts

Replacement of Fixtures. Grantor shall not, without the prior written consent of Beneficiary, permit any of the Fixtures to be removed at any time from the Land or Improvements, unless the removed item is removed temporarily for maintenance and repair or, if removed permanently, is obsolete and is replaced by an article of equal or better suitability and value, owned by Grantor subject to the liens and security interests of this Deed of Trust and the other Loan Documents, and free and clear of any other lien or security interest except such as may be permitted under the Loan Agreement or first approved in writing by Beneficiary.

Replacement of Fixtures. Grantor shall not, without the prior written consent of Beneficiary, permit any of the Fixtures to be removed at any time from the Land or Improvements, unless the removed item is removed temporarily for maintenance and repair or, if removed permanently, is obsolete and is replaced by an article of equal or better suitability and value, owned by Grantor subject to the liens and security interests of this Deed of Trust and the other Loan Indebtedness Documents, and free and clear of any other lien or security interest except such as may be permitted under the Loan Agreement Indenture or first approved in writing by Beneficiary.

Replacement of Fixtures. Other than Permitted Asset Dispositions, Grantor shall not, without the prior written consent of Beneficiary, permit any of the Fixtures owned or leased by Grantor to be removed at any time from the Land or Improvements, unless the removed item is removed temporarily for maintenance and maintenance, repair or, if or replacement or is otherwise permitted to be removed permanently, is obsolete and is replaced by an article of equal the Base Indenture or better suitability and value, owned by Grantor subject to the liens and security interests of this Deed of Trust and the other Loan Related Documents, and free and clear of any other lien or security interest except such as may be permitted under the Loan Agreement or first approved in writing by Beneficiary.

Replacement of Fixtures. Subject to the terms of the Collateral Trust Agreement and the Credit Agreement, Grantor shall not, without the prior written consent of Beneficiary, permit any of the Fixtures owned or leased by Grantor to be removed at any time from the Land or Improvements, unless the removed item is removed temporarily for maintenance and repair oror is permitted to be so removed, if removed permanently, or is obsolete and is replaced by an article of equal or better suitability and value, owned by Grantor subject not material to the liens and security interests of this Deed of Trust and the other Loan Documents, and free and clear of any other lien or security interest except such as may be permitted under the Loan Agreement or first approved in writing by BeneficiaryGrantor’s continuing business operations.

Grantor shall not, without the prior written consent of Beneficiary, permit any of the Fixtures to be removed at any time from the Land or Improvements, unless the removed item is removed temporarily for maintenance and repair or, if removed permanently, is obsolete and is replaced by an article of equal or better suitability and value, owned by Grantor subject to the liens and security interests of this Deed of Trust and the other Loan Documents, and free and clear of any other lien or security interest except such as may be permitted under the Loan Credit Agreement or first approved in writing by Beneficiary.

Grantor shall not, without the prior written consent of Beneficiary, permit any material portion of the Fixtures to be removed at any time from the Land or Improvements, unless the removed item is removed temporarily for maintenance and repair or, if removed permanently, is obsolete and is replaced by an article of equal or better suitability and value, owned by Grantor subject to the liens and security interests of this Deed of Trust and the other Loan Secured Documents, and free and clear of any other lien or security interest except such for Permitted Collateral Liens or as may be permitted under the Loan Agreement or first approved in writing by BeneficiaryIndenture.

Grantor shall not, without the prior written consent of BeneficiaryAgent, permit any of the Fixtures to be removed at any time from the Land or Improvements, unless the removed item is removed temporarily for maintenance and repair or, if removed permanently, is obsolete and is replaced by an article of equal or better suitability and value, owned by Grantor subject to the liens and security interests of this Deed of Trust Mortgage and the other Loan Financing Documents, and free and clear of any other lien or security interest except such as may be permitted under the Loan Agreement or first approved in writing by BeneficiaryAgent.

Grantor shall not, without the prior written consent of Beneficiary, permit any of the Fixtures to be removed at any time from the Land or Improvements, unless the removed item is removed temporarily for maintenance and repair or, if removed permanently, is obsolete and is replaced by an article of equal or better suitability and value, owned by Grantor subject to the liens and security interests of this Deed of Trust Trust, the Intercreditor Agreement and the other Loan Note Documents, and free and clear of any other lien or security interest except such as may be permitted under the Loan Agreement Indenture or first approved in writing by Beneficiary.

Grantor shall not, without the prior written consent of Beneficiary, permit any material portion of the Fixtures to be removed at any time from the Land or Improvements, unless the removed item is removed temporarily for maintenance and repair or, if removed permanently, is obsolete and is replaced by an article of equal or better suitability and value, owned by Grantor subject to the liens and security interests of this Deed of Trust and the other Loan Documents, and free and clear of any other lien or security interest except such for Permitted Liens or as may be permitted under the Loan Credit Agreement or first approved in writing by Beneficiary.
