Common use of Replacement of Panelists Clause in Contracts

Replacement of Panelists. 1. If a panelist resigns, is removed, or becomes unable to serve, the time frames applicable to that panel’s proceeding shall be suspended until a replacement is appointed and shall be extended by the amount of time that the work was suspended. 2. If a panelist resigns, is removed, or becomes unable to serve on the panel, a replacement panelist shall be appointed within 15 days in accordance with the same method used to select the panelist in accordance with Article 31.9 (Panel Composition). 3. If a disputing Party believes that a panelist is in violation of the Code of Conduct, the disputing Parties shall consult. If they concur on removing the panelist, they shall be removed and a new panelist shall be selected in accordance with this Article.
