BioMarin acknowledges and agrees that the purposes of the requirements contained in this Section 4.8(e) are to enable Medicis to comply with the current public information requirement contained in paragraph (c) of Rule 144 should Medicis ever wish to dispose of any of the Restricted Stock without registration under the Securities Act in reliance upon Rule 144 (or any other similar exemptive provision).
