Common use of Reporting to Covered Entity Clause in Contracts

Reporting to Covered Entity. Business Associate shall immediately report to Covered Entity any use or disclosure of PHI not provided for by this Addendum, including breaches of unsecured PHI in accordance with the Breach Notification Rule (45 CFR Subpart D), and any security incident of which it becomes aware. Business Associate shall cooperate with Covered Entity’s investigation, analysis, notification and mitigation activities, and shall be responsible for all costs incurred by Covered Entity for those activities.

Reporting to Covered Entity. Business Associate shall immediately promptly report to Covered Entity any information that may indicate that a use or disclosure of PHI not provided for permitted by this AddendumAddendum has occurred, including breaches of unsecured PHI in accordance with the Breach Notification Rule (45 CFR C.F.R. Part 164, Subpart D), ) and any security incident of which it becomes awareSecurity Incident. Business Associate shall reasonably cooperate with Covered Entity’s investigation, analysis, notification and mitigation activities, and shall be responsible for all costs incurred by Covered Entity for those activities.
