Common use of Reports and Returns Clause in Contracts

Reports and Returns. In case any report or return shall be required to be made with respect to any Tax that is the obligation of Charterer under this Article 17, Charterer shall (i) to the extent required or permitted by law, and provided that Charterer has been furnished at such Indemnified Person’s expense with such information, not within the control of Charterer, as (x) is in such Indemnified Person’s control, (y) is reasonably available to such Indemnified Person, and (z) is necessary to file such report, return or statement, make and file in its own name such return, statement or report, and (ii) in the case of any other such return, statement or report required to be made in the name of any Indemnified Person, advise such Indemnified Person of such fact and prepare such return, statement or report for filing by such Indemnified Person or, where such return, statement or report shall be required to reflect items in addition to any obligations of Charterer under or arising out of this Article 17, provide such Indemnified Person with information sufficient to permit such return, statement or report to be properly made with respect to any Tax that is the obligation of Charterer under this Article 17.
