Common use of Reports and Testing Clause in Contracts

Reports and Testing. Borrower shall (a) upon the request of Administrative Agent, promptly deliver to Administrative Agent copies of all reports, studies, inspections and tests made on the Land, the New Improvements or any materials to be incorporated into the New Improvements that are in the control or possession of Borrower, Guarantor or their Affiliates or agents; and (b) make such additional tests on the Land, the New Improvements or any materials to be incorporated into the New Improvements as Administrative Agent reasonably requires. Borrower shall immediately notify Administrative Agent of any report, study, inspection or test that indicates any adverse condition relating to the Land, the New Improvements or any such materials.
