Common use of Reports to the Representative Clause in Contracts

Reports to the Representative. For a period of three (3) years after the date of this Agreement, so long as the Company is subject to the reporting requirements of either Section 13 or Section 15(d) of the Exchange Act, the Company shall furnish or make available to the Representative copies of all reports or other communications (financial or other) furnished to stockholders, and to deliver to the Representative as soon as they are available copies of any reports and financial statements furnished to or filed with the Commission under the Exchange Act; provided that no reports, documents or other information need to be furnished pursuant to this Section 3.6 to the extent that they are available on the Commission’s XXXXX system.
