Representation and Warranty of the Assignor. The Assignor hereby represents and warrants that it is a "citizen of the United States" as defined in Section 40102(a)(15) of the Federal Aviation Act and that it holds a carrier operating certificate issued by the Secretary of Transportation pursuant to Chapter 447 of Title 49, United States Code, for aircraft capable of carrying ten or more individuals or 6,000 pounds or more of cargo.
