Common use of Representation of the Discharger Clause in Contracts

Representation of the Discharger. As a material consideration for the Regional Water Board’s acceptance of this Stipulation and Order, the Discharger represents that it will utilize the funds as described on page 11 of the project proposal contained in Exhibit “A” to implement the Compliance Project in accordance with the implementation schedule set forth above in Section III, Paragraph 10. The Discharger understands that its promise to implement the Compliance Project, in its entirety and in accordance with the schedule for implementation, is a material condition of this settlement of liability between the Discharger and the Regional Water Board.

As a material consideration for the Regional Water Board’s acceptance of this Stipulation and entry of the Proposed Order, the Discharger represents that it will utilize the funds as described on page 11 of the project proposal contained outlined in Exhibit “A” Paragraphs 3 and 7 to implement the Compliance Project SEP in accordance with the implementation Project Milestones and Budget schedule set forth above contained in Section III, Paragraph 10. Attachment B. The Discharger understands that its promise to implement the Compliance ProjectSEP, in its entirety and in accordance with the Project Milestones and Budget schedule for implementationperformance, is a material condition of this settlement of the administrative civil liability between the Discharger and the Regional Water Board.

As a material consideration for the Regional Water Board’s acceptance of this Stipulation and OrderStipulation, the Discharger represents that it will utilize the funds as described on page 11 of the project proposal contained in Exhibit “A” Attachment B to implement the Compliance Project CP in accordance with the implementation schedule set forth above in Section III, Paragraph 10above. The Discharger understands that its promise to implement the Compliance ProjectCP, in its entirety and in accordance with the schedule for implementation, is a material condition of this settlement of liability between the Discharger and the Regional Water Board.

The Discharger understands that its promise obligation to implement the Compliance ProjectSEP, in its entirety and in accordance with the schedule for implementation, is a material condition of this settlement of liability between the Discharger and the Regional Water Board.

Attachment B. The Discharger understands that its promise to implement the Compliance Projectthree (3) SEPs, in its entirety and in accordance with the schedule for implementation, is a material condition of this settlement of liability between the Discharger and the Regional Water Board.
