Common use of Representation or Warranty Clause in Contracts

Representation or Warranty. Any representation or warranty made or deemed made by the Borrower or any Restricted Subsidiary herein or in any writing furnished in connection with or pursuant to the Loan Documents, or any report certificate, financial statement, or other information provided by others and furnished by the Borrower or any Restricted Subsidiary to the Bank in connection with or pursuant to the Loan Documents, shall be false or misleading in any material respect on the date when made or when deemed made.

Representation or Warranty. Any representation representation, warranty or warranty certification by or on behalf of the Borrower or any of its Subsidiaries made or deemed made herein, in any other Loan Document, or which is contained in any certificate, document or financial or other statement by the Borrower or Borrower, any Restricted Subsidiary herein or in any writing furnished in connection with or pursuant to the Loan Documentsof its Subsidiaries, or any report certificateof their respective Responsible Officers, financial statementfurnished at any time under this Agreement, or in or under any other information provided by others and furnished by the Borrower or any Restricted Subsidiary to the Bank in connection with or pursuant to the Loan DocumentsDocument, shall be false or misleading prove to have been incorrect in any material respect on or as of the date when made or when deemed made.; or

Representation or Warranty. Any representation or warranty made or deemed made by or on behalf of (a) the Borrower Borrower, General Partner or any Restricted Subsidiary herein of their Subsidiaries or (b) the Trust to the Bank herein, or in any report, certificate, financial statement or other writing furnished in connection with or pursuant to the this Loan Documents, Agreement or any report certificateother Loan Document shall prove to be false, financial statement, misleading or other information provided by others and furnished by the Borrower or any Restricted Subsidiary to the Bank in connection with or pursuant to the Loan Documents, shall be false or misleading incomplete in any material respect on the date when made or when deemed as of which made.
