Common use of Representations and Warranties of BN Clause in Contracts

Representations and Warranties of BN. BN represents and warrants that: (a) it shall not use Crucell Technology or Crucell Patent Rights, directly or indirectly, otherwise than is provided for in the terms of this Agreement and the Supply Agreement; (b) to its knowledge, prior to the Effective Date, BN has not received any written notification that the BN Technology infringes any rights of any Third Parties; and (c) that it Controls the right to grant all the rights that it is granting herein.
