Representations and Warranties of CRICC. CRICC represents and warrants to PA that, to its knowledge, CRICC holds an exclusive license to use the IH2 technology for the purposes of this Agreement and; that CRICC has the right and power to enter into this Agreement; that there are no other agreements with any other party in conflict with this Agreement or the rights conferred herein; and that the use of the IH2 Technology in Testing and Evaluation, to the best of CRICC’s knowledge will not infringe any valid U.S. patent or copyright, or other proprietary right of any other person or entity.
