REPRESENTATIONS AND WARRANTIES OF THE BANK AND THE PROPERTY TRUSTEE. The Bank and Property Trustee, as of the date hereof, and each successor Property Trustee at the time of the successor Property Trustee's acceptance of its appointment as Property Trustee hereunder (the term "Bank" being used hereafter in this Article VII to refer to such successor Property Trustee in its separate corporate capacity and as Property Trustee), hereby represents and warrants as to itself (as applicable) for the benefit of the Depositor and the Securityholders that:
