Common use of Representations and Warranties with Respect to the Leases Clause in Contracts

Representations and Warranties with Respect to the Leases. Trustor represents and warrants with respect to all Leases, whether entered into now or hereafter, that throughout the stated term thereof: (a) It has a valid and subsisting interest as lessor under said Leases; (b) The Leases are in full force and effect; (c) There are no defaults thereunder and no event has occurred or is occurring which after notice or passage of time or both will result in such a default; (d) The Leases and the rents, issues and profits thereof are subject to no encumbrances of any kind except for this Deed of Trust; and (e) True and correct copies of said Leases have been, or upon execution will be, delivered by Trustor to Beneficiary and there are no modifications, amendments, cancellations or concessions not indicated by the copies so delivered.
