Common use of Representations of Developer Clause in Contracts

Representations of Developer. By execution of a lease for a Rental Affordable Unit, Developer shall be deemed to represent and warrant to the Agency, which may rely on the following, that: (i) the Household is determined to be a Qualified Tenant by the Certifying Authority, and (ii) Developer is not collecting more than the Maximum Allowable Rent.

Representations of Developer. By execution of a lease for a Rental Affordable workforce Housing Unit, the Developer shall be deemed to represent and warrant to the AgencyCity, which may rely on the following, that: (i) based upon tenant supplied information, the Household is determined to be a Qualified Tenant by the Certifying AuthorityTenant, and (ii) the Developer is not collecting charging the Workforce Housing Unit tenant more than the Maximum Allowable Rent.
