Common use of Representations Regarding the Funds Clause in Contracts

Representations Regarding the Funds. Dealer and its Representatives are not authorized to make any representations concerning the Shares or the Funds except those contained in the Prospectus and in printed information provided by MFD or its designated agent as information supplemental to the Prospectus. In the event Dealer develops and creates advertising or sales materials with respect to the Shares or the Funds, all such materials must be approved by MFD or its designated agent prior to its use. Dealer shall be responsible for compliance and any required filing of such advertising or sales materials with FINRA or any other applicable regulatory authority.
