Common use of Representative Capacity; Nonrecourse Clause in Contracts

Representative Capacity; Nonrecourse. The Custodian agrees that any claims by it against the Fund under this Agreement may be satisfied only from the assets of the Fund; that the person executing this Agreement has executed it on behalf of the Fund and not individually, and that the obligations of the Fund arising out of this Agreement are not binding upon such person or the Fund's shareholders individually but are binding only upon the assets and property of the Fund; and that no shareholders, directors or officers of the Fund may be held personally liable or responsible for any obligations of the Fund arising out of this Agreement.
