Representing the Association. 2 a. In order that members of the Association may attend conferences, 3 conventions, workshops, or meetings as called or directed by that 4 organization, and in order to accomplish the purpose of RCW 41.59, at least 5 sixty (60) days absence for each year of the Agreement shall be granted to 6 the Association by request. Any employee using this absence must be 7 replaced by a substitute. The cost of the substitute shall be paid by the 8 Association on a quarterly basis. Employees using this leave must give two 9 (2) days written notice in advance to the Superintendent or Superintendent's 10 designee in order to be released. The Association shall allocate the 11 scheduling of these absences so as not to impair the continuity of instruction.
12 b. In the event that the State Auditor or a court of competent jurisdiction 13 rules this leave to be contrary to law or regulation, the leave shall 14 thereupon be determined null and void and all necessary adjustments shall 15 be made by the District and the Association to conform to the law as 16 determined by the Auditor or court of competent jurisdiction and the 17 Association shall reimburse the District for any funds determined to have 18 been paid improperly by the District. In the event the Association fails to 19 reimburse the District, the amount for the released time shall be deducted 20 from the employee's salary check. The Association expressly agrees to 21 indemnify and hold the District harmless against any and all claims, 22 demands, suits, attorney's fees or other forms of liability that may arise out 23 of, or by reason of, the District's compliance with the terms of this section. 24
