Common use of Repricing of Stock Options Clause in Contracts

Repricing of Stock Options. Nothing contained in this Agreement shall limit or restrict the Borrower from exchanging, replacing and/or amending the terms and provisions of any and all options currently outstanding pursuant to the Rotech Healthcare Inc. Common Stock Option Plan in order to effect a repricing of such options.

Common Stock Option Plan in order to effect a Plan, whether such repricing of such optionsis effected by exchange, replacement, amendment or otherwise.
