Common use of Repurchase of Interests in Certain Event Clause in Contracts

Repurchase of Interests in Certain Event. (a) In the discretion of the Board of Directors, the Company may, but is not obligated to, repurchase a Member's Membership Interest upon a breach by the Member or any of its Affiliates of the Member's obligations contained in Article III, Sections 5.10, and 8.1 of this Agreement.

(a) In the discretion of the Board of Directors, the Company may, but is not obligated to, repurchase a Member's Membership Interest upon a such Member's breach by the Member or any of its Affiliates of the Member's obligations contained in Article III, Sections 5.10, 7.1 and 8.1 7.2 of this Agreement, unless the breach is cured promptly after notice thereof by the Company.
