Request for Clarification. Any of the parties may request, within fifteen (15) days as from the notification date of the award, its clarification of the award. The Arbitration Tribunal shall resolve on the request for clarification within fifteen (15) days as from its filing. Clarifications shall be given by the Arbitration Tribunal rendering the award. Should the Arbitration Tribunal consider that circumstances so require, it may postpone the enforcement of the award until it resolves the request submitted.
Request for Clarification. The Contractor may request that the Province agree that a particular design element or construction specification complies with the Project Requirements, and if the Province so agrees then such design element or construction specification shall be deemed to comply with the Project Requirements. However, the Province must consider such a request only where:
(a) the request is in relation to a specific design element or construction specification;
(b) the pertinent Project Requirements are capable of differing interpretations in relation to the specific design element or construction specification;
(c) the Contractor has established that it would be exposed to significant risk of material expense or delay if its interpretation of the pertinent Project Requirements ultimately proved to be incorrect; and
(d) the Contractor has not made multiple or generalized requests under this Section such that in the reasonable opinion of the Province the Contractor is attempting to use this Section to transfer to the Province all or partial responsibility for ensuring that the Project meets the Project Requirements.
Request for Clarification. 1. Each State Party shall have the right to request another State Party for clarification concerning any situation which may be considered ambiguous or which may give rise to doubts about the compliance of that State Party with this Treaty. It shall inform the Executive Committee of such a request. The requested State Party shall duly respond by providing without delay the necessary information and inform the Executive Committee of its reply to the requesting State Party.
2. Each State Party shall have the right to request the Executive Committee to seek clarification for another State Party concerning any situation which may be considered ambiguous or which may give rise to doubts about compliance of that State Party with this Treaty. Upon receipt of such a request, the Executive Committee shall consult the State Party from which clarification is sought for the purpose of obtaining the clarification requested.
Request for Clarification. Any Bidder who finds discrepancies in, or omissions from, any provision of the ITB, Specifications, or Contract Documents, or has doubt as to the meaning, shall make a request for clarification in writing, to the OETC Contract Administrator listed on Page 2 of the ITB. To be considered, the request for clarification must be received no later than seven (7) calendar days prior to the Bid Closing Date.

Request for Clarification. The Contractor may request that the Province agree that a particular design element or construction specification complies with the Project Requirements, and if the Province so agrees (the Province will endeavor to determine its position on the request within 10 days of receiving the request), then such design element or construction specification shall be deemed to comply with the Project Requirements. However, the Province must consider such a request only where:
(a) the request is in relation to a specific design element or construction specification;
(b) the pertinent Project Requirements are capable of differing interpretations in relation to the specific design element or construction specification;
(c) the Contractor has established that it would be exposed to significant risk of material expense or delay if its interpretation of the pertinent Project Requirements ultimately proved to be incorrect; and
(d) the Contractor has not made multiple or generalized requests under this Section such that, in the reasonable opinion of the Province, the Contractor is attempting to use this Section to transfer to the Province all or partial responsibility for ensuring that the Project meets the Project Requirements.
Request for Clarification. Any Offeror requiring clarification of any provision of the ITB may make a request for clarification in writing, to the contact point listed in C.2.3 "SINGLE POINT OF CONTACT". To be considered, ODOC must receive the request for clarification by the deadline specified in C.5.6.
C.5.3.1 RESPONSE TO REQUESTS FOR CLARIFICATION; CLARIFICATIONS, WHETHER VERBAL, IN WRITING, OR INCLUDED IN AN ADDENDUM AS A "CLARIFICATION," DO NOT CHANGE SPECIFICATIONS, CONTRACTUAL TERMS, OR PROCUREMENT REQUIREMENTS OF AN ITB. IF A REQUEST FOR CLARIFICATION RAISES AN ISSUE THAT THE ODOC DETERMINES SHOULD BE HANDLED BY FORMALLY AMENDING THE ITB, THE ODOC WILL DO SO ONLY BY ANNOUNCING SUCH A CHANGE IN THE ADDENDUM, NOT THROUGH INFORMATION IDENTIFIED AS A "CLARIFICATION." (Refer to Section C.5.6.) C.5.4 REQUEST FOR CHANGES TO CONTRACTUAL TERMS OR SPECIFICATIONS: Any Offeror may submit a request for changes to contractual terms or Specifications, in writing, to the contact point listed in C.2.3 "SINGLE POINT OF CONTACT". To be considered, ODOC must receive the request for changes by the deadline specified in C.5.6. Offeror must include in the request the reason for requested changes, supported by factual documentation, and any proposed changes.
C.5.4.1 If any omitted specification results in ambiguity as to material characteristics of the Services, and inclusion is necessary to enable a reasonable person in the particular industry to properly identify such characteristics, an Offeror shall seek a formal request for change, as set forth this section C.5.4. Failure to make such a request is at Contractor's risk, and the Offeror awarded a Price Agreement shall be required to provide Services meeting the Agency's needs with regard to any omitted specification for which change should reasonably have been sought.
Request for Clarification. Request for Clarification. Any Proposer that finds discrepancies in, or omissions from any provision, procedure or requirement of the RFP or the terms and conditions of the Agreement, or has doubt as to the meaning of any provision, procedure or requirement of the RFP or the terms and conditions of the Agreement may make a request for clarification in writing in strict accordance with the applicable provisions of Section C.3.1.
