Request for further information. If:
(a) a Certifier provides a Certificate of Compliance to Aurizon Network under
(b) Aurizon Network requests (which may be on one or more occasions) the Operator to provide any information or documentation (including reports on trials and/or commissioning tests) in relation to the Rollingstock or Rollingstock Configurations for a Train Service Type (as applicable) specified in that Certificate of Compliance, then the Operator must provide (or procure the Certifier to provide) that information or documentation to Aurizon Network promptly (and in any event, within 10 Business Days) after being requested to do so by Aurizon Network.
Request for further information. The State may at any time request further information from the Grantee for the purpose of assisting the State in satisfying itself of the matters referred to in clause 4.1(c), (d) and (e). The Grantee must comply with the State's request:
a) within 15 Business Days after the request for further information is made by the State; or
b) within 40 Business Days following the Operations Commencement Date, whichever is the earlier.
Request for further information. Where any further information, data or documents are required by the City to fully:
(a) appreciate, understand or review a Submittal; or
(b) understand the Submittal’s implications or relationship to other components of the Project Work, is not provided with the Submittal, the City may request in writing such further information, data or documents. Where the City requests further information, data or documents in accordance with this Section:
(a) Design-Builder shall, within 5 Business Days, submit such further or other information, data and documents and take such other steps as may be required to satisfy the City that the Submittal complies with the applicable Project Requirements;
(b) the remainder of the applicable Review Period shall be postponed until such time as the City has received the requested information, data and/or documents, provided that the City shall, in its discretion, have up to 10 additional Business Days beyond the end of the postponed Review Period, to complete its review of a Submittal following receipt of all such requested further information, data and documents; and
(c) failing to provide the information within the required timeframe may result in a “Rejected” endorsement at the City’s discretion in accordance with Section 8(e).
Request for further information. If:
(a) a Certifier provides a Certificate of Compliance to Aurizon Network under
(b) Aurizon Network reasonably requests (which may be on one or more occasions) the End User to provide any information or documentation (including reports on trials and/or commissioning tests) in relation to the Rollingstock or Rollingstock Configurations for a Train Service Type (as applicable) specified in that Certificate of Compliance, then the End User must provide (or procure the Operator and/or the Certifier to provide) that information or documentation to Aurizon Network promptly (and in any event, within 10 Business Days) after being requested to do so by Aurizon Network.
Request for further information.
(1) The Minister may ask the applicant for further information about the application.
(2) The request must—
(a) be in writing; and
(b) be given to the applicant; and
(c) specify the time within which the information must be provided.
(3) Information requested under subsection (1) must be provided—
(a) in writing; and
(b) within the time specified in the request.
Request for further information. If Xxxxx’s Representative, acting reasonably and without delay, makes a written request to the Contractor for further or other information, data or documents in order to fully consider a Submittal:
(a) the Contractor will, in a form that facilitates BC Hydro’s use of the additional information:
(i) no later than seven days following such request, submit to Hydro’s Representative such further or other information, data and documents; and
(ii) take all such steps as may be required to satisfy Hydro’s Representative that the proposed information, data and documents or the Contractor’s proposed course of action complies with the Contract; and
(b) the time periods referred to in Section 4.1 or Section 4.2 of this Schedule 5 [Submittals Procedure], as the case may be, will not commence to run until such time as Hydro’s Representative has received the requested information, data or documents from the Contractor. The Contractor may request confirmation of receipt for the purposes of confirming the commencement of a time period.
Request for further information. Where any information, data or documents required to fully:
(a) appreciate, understand or review a Submittal; or
(b) understand the Submittal’s implications or relationship to other components of the Project Work, is not provided with the Submittal, the City may reject the Submittal in accordance with Section 8(e) [Grounds for Rejection and Observations] of this Schedule or request such information, data or documents in writing. Where the City requests further information, data or documents in accordance with this Section:
(c) Project Co shall promptly submit such further or other information, data and documents and take such other steps as may be required to satisfy the City that the Submittal complies with the applicable Project Requirements; and
(d) the remainder of the applicable Review Period shall be postponed until such time as the City has received the requested information, data and/or documents, provided that under no circumstances will the City have less than 2 Business Days to complete its review of a Submittal after having received all requested information, data and documents.
Request for further information. The Executive will respond to any reasonable requests for further information from BEIS as soon as reasonably practicable.
Request for further information. If:
(a) a Certifier provides a Certificate of Compliance to Aurizon Network under
(b) Aurizon Network reasonably requests the Operator to provide any information or documentation (including reports on trials and/or commissioning tests) in relation to the Rollingstock or Rollingstock Configurations for a Train Service Type (as applicable) specified in that Certificate of Compliance, then the Operator must provide (or procure the Certifier to provide) that information or documentation to Aurizon Network promptly (and in any event, within 10 Business Days) after being requested to do so by Aurizon Network.
16.7 Decision by Aurizon Network Within 20 Business Days (or such longer period agreed between the Parties) after the later of the date that:
(a) a Certifier provides a Certificate of Compliance to Aurizon Network under
(b) Aurizon Network is provided with all information or documentation requested by Aurizon Network under clause 16.6, Aurizon Network must:
(c) if Aurizon Network is reasonably satisfied that the Rollingstock or Rollingstock Configurations for the Train Service Type (as applicable) specified in the Certificate of Compliance complies with the Rollingstock Interface Standards (subject to any Approved Derogations), notify the Operator that, as applicable:
(i) the Rollingstock specified in the Certificate of Compliance is taken to be Authorised Rollingstock; or
(ii) the Rollingstock Configurations for the Train Service Type specified in the Certificate of Compliance is taken to be Authorised Rollingstock Configurations for that Train Service Type; or
(d) if Aurizon Network is not reasonably satisfied that the Rollingstock or Rollingstock Configurations for the Train Service Type (as applicable) specified in the Certificate of Compliance complies with the Rollingstock Interface Standards (subject to any Approved Derogations), notify the Operator that:
(i) it is not satisfied that the Rollingstock or Rollingstock Configurations for the Train Service Type (as applicable) specified in the Certificate of Compliance complies with the Rollingstock Interface Standards (subject to any Approved Derogations), and provide reasonable details of any non-compliance; and
(ii) as applicable:
(A) the Rollingstock specified in the Certificate of Compliance is not taken to be Authorised Rollingstock; or
(B) the Rollingstock Configurations for the Train Service Type specified in the Certificate of Compliance is not taken to be Authorised Rollingstock Configurations ...
