Common use of REQUESTS FOR ISSUE OF LETTERS OF CREDIT OR GUARANTEES Clause in Contracts

REQUESTS FOR ISSUE OF LETTERS OF CREDIT OR GUARANTEES. A Borrower shall give to the Agent four business days' prior written notice of that Borrower's request for the issue of any Letter of Credit or Guarantee. In the case of a Guarantee, such notice shall specify the maximum contingent liability to be guaranteed, the beneficiary in whose favour the Guarantee is to be issued, the effective date of issue of such Guarantee (which shall be a business day), details of the obligation in respect of which the contingent liability might arise and the date on which such obligation is due to mature or expire. In the case of a Letter of Credit, such notice shall specify the original face amount and currency denomination of the Letter of Credit requested, the effective date of issue of such Letter of Credit (which shall be a business day), whether such Letter of Credit may be drawn in a single or partial draws, the date on which such Letter of Credit is to expire and the beneficiary of such Letter of Credit.
