Common use of Requests for Remittances Clause in Contracts

Requests for Remittances. (1) Requests for remittances shall be handled as follows: (i) Requests for remittances shall only be received during business hours prescribed by the Bank. (ii) When requesting a remittance, the applicant is required to submit the Application for Remittance as prescribed by the Bank, correctly stating the information prescribed by the Bank such as the type of remittance, method of payment, name of the branch or office of the Paying Bank, payee's name, account number or address and telephone number of the payee, amount of remittance, and applicant's name; and placing the applicant's signature or affixing the applicant's name and seal. (iii) The Bank shall deem the details stated in the Application for Remittance provided for in the preceding Subparagraph as the content of the request. (2) When receiving a request for remittance, the Bank is requested to ascertain certain matters under laws and regulations governing foreign exchange. The applicant is, therefore, required to satisfy the following requirements: (i) The purpose for remittance and any other required information shall be stated in the Application for Remittance. (ii) The funds for remittance are to be debited from an account of the applicant identified by official documents. The Bank shall not handle any transactions requiring permission or such. (3) When requesting a remittance, the applicant is required to pay to the Bank the funds to be remitted as well as remittance charges and any other charges and expenses required in connection with this transaction as prescribed by the Bank (hereinafter referred to collectively as the "Remittance Funds"). If the balance of the savings deposit account from which the Remittance Funds will be deducted falls short of the amount of Remittance Funds, the remittance request will not be accepted. The Bank shall not accept the Remittance Funds in the form of checks or other instruments. (4) Foreign remittances may be delayed due to complicated procedures unique to foreign remittances or local conditions. The applicant, therefore, is requested to allow enough time to make an overseas remittance transaction. (5) Please note that a foreign remittance is different from a domestic fund transfer in terms of operational procedures, the Bank’s responsibility, etc. because of local conditions, customs, and other factors.
