Common use of Required Aggregation Group Clause in Contracts

Required Aggregation Group. (1) Each qualified Plan of the Employer in which at least one Key Employee participates or participated at any time during the determination period (regardless of whether the Plan has terminated), and (2) any other qualified Plan of Employer which enables a Plan described in (1) to meet the requirements of Section 401(a)(4) or Section 410 of the Code.

Required Aggregation Group. (1) Each qualified Plan plan of the Employer in which at least one a Key Employee participates is a Participant or participated was a Participant at any time during the determination period (regardless of whether the Plan has terminated), ) and (2) any other qualified Plan plan of the Employer which that enables a Plan plan described in (1) to meet the requirements of Section Code sections 401(a)(4) or Section 410 of the Code410.

(1) Each qualified Plan plan of the Employer or Related Employer in which at least one Key Employee participates participates, or has participated at any time during the determination period (regardless of whether the Plan plan has terminated), and (2) any other qualified Plan plan of the Employer or Related Employer which enables a Plan plan described in (1) above to meet met the requirements of Section Sections 401(a)(4) or Section 410 of the Code.
