Common use of Rescission Rights Clause in Contracts

Rescission Rights. If the Company fails to cause the Depositary to transmit to the Holder the Warrant ADSs pursuant to Section 2(d)(i) by the Warrant ADS Delivery Date, then the Holder will have the right to rescind such exercise.

Rescission Rights. If the Company fails to cause the Depositary to transmit deliver to the Holder the Warrant ADSs pursuant to Section 2(d)(i) by the Warrant ADS Delivery Date, then the Holder will have the right to rescind such exercise.

Rescission Rights. If the Company fails to cause the Depositary Depository to transmit to the Holder the Warrant ADSs pursuant to Section 2(d)(i) by the Warrant ADS Delivery Date, then the Holder will have the right to rescind such exercise.

If the Company fails to (A) cause the Depositary to transmit to the Holder the Warrant ADSs pursuant to Section 2(d)(i) by the Warrant ADS Delivery Date, or (B) to cause the Company’s Transfer Agent to transmit to the Holder the Warrant Shares pursuant to Section 2(d)(ii) by the Warrant Share Delivery Date, as applicable, then the Holder will have the right to rescind such exercise.

If the Company fails to cause the Depositary to transmit to the Holder the Warrant ADSs pursuant to Section 2(d)(i2(c)(i) by the Warrant ADS Delivery Date, then the Holder will have the right to rescind such exercise; provided, however, that the Holder shall be required to return any Warrant ADSs or Ordinary Shares subject to any such rescinded Notice of Exercise concurrently and the restoration of Holder’s right to acquire such Warrant ADSs pursuant to this Warrant (including, issuance of a replacement Warrant evidencing such restored right).

Rescission Rights. If the Company fails to cause the Depositary to transmit to the Holder the Warrant ADSs pursuant to Section 2(d)(i2(e)(i) by the Warrant ADS Delivery Date, then the Holder will have the right to rescind such exercise.

If the Company fails to cause the Depositary to transmit deliver to the Holder the Warrant ADSs pursuant to Section 2(d)(i) by the Warrant ADS Delivery Date, then the Holder will have the right to rescind such exerciseexercise by delivering written notice to the Company at any time prior to the delivery of such Warrant ADSs.

Rescission Rights. If the Company fails to cause the Depositary to transmit deliver to the Holder Holder, or its nominee, the Warrant ADSs pursuant to Section 2(d)(i) by the Warrant ADS ADSs Delivery Date, then the Holder will have the right to rescind such exercise.

If the Company fails to cause the Depositary to transmit to the Holder the Warrant ADSs pursuant to Section 2(d)(i) by the Warrant ADS Delivery Date, then the Holder will have the right to rescind such exerciseexercise in respect of the untransmitted Warrant ADSs (with the effect that the Holder’s right to acquire such Warrant ADSs pursuant to this Warrant shall be restored) and the Company shall return to the Holder the aggregate Exercise Price actually paid to the Company for such Warrant ADSs.

Rescission Rights. If the Company fails to cause the Depositary to transmit deliver to the Holder the Warrant ADSs pursuant to Section 2(d)(i2(e)(i) by the Warrant ADS Delivery Date, then without derogating from any remedy available to Holder under applicable law or agreement, the Holder will have the right to rescind such exercise.
