Common use of Reservation of Shares Clause in Contracts

Reservation of Shares. The Company shall ensure that there are at all times sufficient shares of Common Stock to provide for the issuance, free of any preemptive rights, out of its authorized but unissued shares of Common Stock or shares of Common Stock held in treasury, of the maximum aggregate number of Shares authorized for issuance by the Board pursuant to the terms of this Agreement. The Company will use its commercially reasonable efforts to cause the Shares to be listed for trading on the Trading Market and to maintain such listing.

Reservation of Shares. The Company shall ensure that there are agrees at all times sufficient shares of Common Stock to provide for the issuance, free of any preemptive rights, reserve and hold available out of its authorized but unissued shares of Common Stock or the number of shares of Common Stock held in treasury, of issuable upon the maximum aggregate number of Shares authorized for issuance by the Board pursuant to the terms full exercise of this AgreementWarrant.
