Common use of Resignation of the Trustee Clause in Contracts

Resignation of the Trustee. The Trustee may resign at any time by delivering a written notice of resignation to the Company and the Indemnitees. Such resignation shall take effect on the date set forth in such notice, which shall be no earlier than 60 days from the date of such delivery to the Company and the Indemnitees unless a shorter time has been agreed upon in writing by the Trustee, the Company and the Indemnitees; provided that a successor trustee has been appointed pursuant to Section 6.7(c).

Resignation of the Trustee. The Trustee may resign at any time and be discharged of the trusts hereby created by delivering a written mailing notice of resignation to the Company Issuer and to all registered holders of Secured Obligations specifying the Indemniteestime and date (not earlier than sixty (60) days after the date of such notice) when such resignation shall take effect. Such resignation shall take effect on upon the date set forth in such noticeappointment, which shall be no earlier than 60 days from the date qualification and acceptance of such delivery to the Company and the Indemnitees unless a shorter time has been agreed upon in writing by the Trustee, the Company and the Indemnitees; provided that a successor trustee has been appointed pursuant to Section 6.7(c)as herein provided.

Such resignation shall take effect be effective on the date set forth in such notice, which shall be no earlier than 60 that is ninety (90) days from after the date of such delivery notice has been delivered by the Trustee to the Company and the Indemnitees unless a shorter time has been Settlor or on such earlier date as may be agreed upon to in writing by the Trustee, the Company Trustee and the Indemnitees; provided that a successor trustee has been appointed pursuant to Section 6.7(c)Settlor.
