Common use of Resignation or Removal of Depositary Clause in Contracts

Resignation or Removal of Depositary. Either the Depositor or the Depositary may terminate this Agreement by giving thirty (30) days prior written notice to the other party. In such event, the duties of the Depositary shall terminate (30) days after receipt of such notice (or as of such earlier date as may be mutually agreeable) and the Depositary shall then deliver the balance of the moneys or assets then in its possession to the Depositor or as the Depositor shall direct.
