Common use of Resignation, Retirement, Death or Disability Clause in Contracts

Resignation, Retirement, Death or Disability. Executive's employment hereunder shall cease at any time by Executive's voluntary resignation or by Executive's Retirement, Death or Disability. Disability shall be deemed to have occurred only after the following procedure has been satisfied: If within thirty (30) days after written notice of proposed Termination for Disability is given to Executive by the Company, Executive has not returned to the full-time performance of his or her duties, the Company may end Executive's employment by giving written notice of Termination for Disability. Such notice may be given by the Company following Executive's absence from Executive's duties by reason of physical or mental disability for one hundred fifty (150) consecutive calendar days.
