Responsibilities of the Contracting Agency. 1. The Contracting Agency shall accept students assigned by Brevard Schools regardless of funding from other sources. 2. The Contracting Agency hereby agrees to indemnify, save harmless, and defend the School Board, its officers, agents, and employees from and against any and all claims, liability, losses, causes of action, cost or expense of whatever kind or nature (including, but not limited to, attorney's fees) which may arise out of activities and operations of the Contracting Agency or its officers, agents or employees in connection with the performance of this Agreement. 3. The Contracting Agency shall comply with the procedures of the School Board to protect the confidentiality of student records and shall provide for appropriate representatives of the School Board to review student records and information. 4. The Contracting Agency hereby agrees that it now complies, and shall continue to comply as long as this Agreement is in effect, with the Civil Rights Act of 1964, Title IV of the Education Amendments of 1974, and Section 504 of the Rehabilitative Act of 1973, as amended. 5. The Contracting Agency shall at all times comply with applicable local, state, or federal law, rules and regulations including standards for health and safety of the student, whichever are more stringent. 6. The Contracting Agency will designate a staff member to be responsible for the administration of the provisions of the contract and for the supervision of the educational program provided to each student under the Agreement. 7. The staff of the School Board will be permitted to review the program provided by the Contracting Agency and confer with the Contracting Agency's staff at reasonable times. 8. The Contracting Agency shall be responsible for submission of a list of student names, placement site and hours of participation. This supporting documentation for accountability must be submitted along with the xxxx for service. Agreement between Brevard Achievement Center and the School Board of Brevard County in effect July 1, 2011 - June 30, 2012.
