Responsibility of the Negotiating Teams. The purpose of the bargaining procedure is to provide a means of obtaining agreement on the issues submitted. If either party determines that the differences of position are so serious that further negotiations seem impossible of producing a satisfactory agreement, either party may declare the unresolved issues to be at impasse. If either party declares impasse, the parties shall jointly request the Federal Mediation and Conciliation Service (FMCS) to appoint a mediator for the purpose of assisting the parties in reaching agreement.
