Common use of Restitution of Payments Clause in Contracts

Restitution of Payments. Without prejudice to any other remedies available to ISR under any agreement and/or under any applicable law, in the event that ISR exercises its right to terminate this Agreement for any of the reasons set forth in Section 20.1, then within thirty (30) days from notification by ISR that it has rescinded or terminated this Agreement, prior to the issuance of Final Acceptance Certificate, Supplier shall return to ISR all payments it has received from ISR in respect of all terminated Works.

Restitution of Payments. Without prejudice to any other remedies available to ISR under any agreement and/or under any applicable law, in the event that ISR exercises its right to terminate this Agreement for any of the reasons set forth in Section 20.123.2-23.3, then within thirty (30) days from notification by ISR that it has rescinded or terminated this Agreement, prior to the issuance of a Final Acceptance Certificate, Supplier shall return to ISR all payments it has received from ISR in respect of all terminated Worksworks.
