Restricted License. 6.1 The Contents may be downloaded and reproduced solely for personal non-commercial or internal use. This is a license and not a transfer of title, and is subject to the following restrictions: The Contents may not be modified or used for any commercial purpose or public display, performance, sale or rental; Software Contents may not be decompiled, reverse engineered or disassembled in any manner whatsoever; No copyright or other proprietary notices may be removed from the Contents; The Contents may not be transferred to another person; and Every person downloading, reproducing or otherwise using the Contents, hereby agrees to prevent any unauthorized copying of the Contents. 6.2 The User shall not download or otherwise export or re-export any software or underlying information or material available through this Website, except to the extent that such downloading occurs in the course of using this Website in accordance with Club Med’s written instructions or otherwise as expressly permitted under these terms and conditions.

Restricted License. 3.1 Unless otherwise specified, the SAP Software is licensed for Standalone Use and in conjunction with the TELCOR Software. Any Third Party Products contained in or provided with the SAP Software may only be used as part of the SAP Software. Licensee’s use of the SAP Software will be solely for the purpose of enabling performance and functionalities of the TELCOR Software (referred to as a “Restricted License”). 3.2 Licensee will not cause the SAP Software acquired hereunder shall not access, directly or indirectly, in any manner whatsoever, any third party runtime database acquired from SAP or its Affiliates or any of its respective resellers or distributors (“Database Restriction”). The Foregoing Database Restriction does not restrict the SAP Software from accessing any other software and/or third party software that is a business application licensed from SAP or its Affiliates or any of its respective resellers or distributors under a separate agreement, on a business process layer via APIs. For clarification, this Agreement does not contain a license to use, directly or indirectly, any SAP or its Affiliates’ software or other third party software (including without limitation, third party runtime database) not listed in an exhibit hereto. Any use or access of such non-licensed software, directly or indirectly, is subject to its respective license agreement which grants direct license rights to such software.

Restricted License. The Software may only be used with the Partner Solution to enable its performance, with data access limited to data created by the Partner Solution or data processed by the Partner Solution that is necessary to enable the functionalities of the Partner Solution (referred to as a “Restricted License”). Partner agrees that Partner Solution must add significant and primary additional functionalities to the Software in order to qualify as Partner Solution. The Bundled Solution must be reviewed and approved by SAP in advance in accordance with SAP’s standard practices before Partner may promote or make it available to its Customers or third parties. Partner agrees to provide such information about the Bundled Solution as reasonably requested by SAP. SAP may deny or withhold approval in its sole discretion. SAP’s approval of the Bundled Solution is not, and will not be construed or represented by Partner to any third party to be a verification of the Bundled Solution functionality or any support, preference, warranty or endorsement of such by SAP in any way.

Restricted License. (a) Partner may market and sublicense the Software (including the Integration) only for Standalone Use (except as otherwise set forth in the applicable Order Form) and in conjunction with the Partner Products pursuant to the licensing and use restrictions as set forth in this Agreement, the Software Use Rights, and such other terms as set forth in the specific Exhibit A for the applicable Software. Any Third Party Products contained in or provided with the Software may only be used as part of the Software. The End User Licenses shall permit the End User’s use of the Software only with the Partner Products, and to the extent Partner Products consists of software (“Partner Applications”), for the sole purpose of enabling performance of the Partner Applications and integrating data from Partner Applications, with data access limited to data created or necessary to enable the functionalities of the Partner Products (referred to as a “Restricted License”). (b) It is the intention of the parties that Partner Products that are software must add significant and primary additional functionalities to the Software in order to qualify as Partner Product. Partner warrants that Partner Products provide significant and primary additional functionalities to the Software. (c) Software licensed under the Agreement shall not access, directly or indirectly, in any manner whatsoever, any third party runtime database acquired from Licensor or its Affiliates or any of its respective resellers or distributors (“Database Restriction”). The foregoing Database Restriction does not restrict the Software from accessing any other software and/or third party software that is a business application licensed from Licensor or its Affiliates or any of its respective resellers or distributors under a separate agreement, on a business process layer via APIs. In the event Partner becomes aware that an End User, distribution, reseller or Partner Affiliate is violating the limitations imposed on this Section 2.3, Partner shall promptly notify Licensor of such. Partner shall reasonably cooperate with Licensor to enforce the limitations imposed according to this Section 2.3 to the fullest extent possible.

Restricted License. If you acquired the Software bundled or otherwise provided in combination with or for use with a third party product (“OEM Application”), you have acquired a Restricted License. You may use each licensed copy of the Software only in conjunction with the OEM Application with which it was provided. Accessing data that is not specifically created or processed by the OEM Application is in violation of this license. If the OEM Application requires the use of a data mart or data warehouse, the Software may be used with the data mart or data warehouse only to access data created or processed by the OEM Application. Restricted Licenses may not be combined with unrestricted licenses in the same Deployment.

Accessing data that is not specifically created or processed by the Designated Equipment is in violation of this license. Restricted Licenses may not be combined with unrestricted licenses in the same Deployment.

Restricted License. If you acquired the Software bundled or otherwise provided in combination with or for use with a third party product (OEM Application), you have acquired a Restricted License. You may use each licensed copy of the Software only in conjunction with the OEM Application with which it was provided. Accessing data that is not specifically created or used by the OEM Application is in violation of this license. If the OEM Application requires the use of a data mart or data warehouse, the Software may be used with the data mart or data warehouse only to access data created or processed by the OEM Application. If you acquired Crystal Xcelsius bundled or otherwise provided in combination with Planning Applications, you have acquired a Restricted License with respect to Crystal Xcelsius. You may use Crystal Xcelsius only in conjunction with the Planning Applications, and accessing data that is not specifically created or used by the Planning Applications is in violation of this license.
