Restricted Rights. Use of the Software by or for the United States Government is conditioned upon the Government agreeing that the Software is subject to Restricted Rights as provided under the provisions set forth in FAR 52.227-19. Customer shall be responsible for assuring that this provision is included in all agreements with the United States Government and that the Software, when delivered to the Government, is correctly marked as required by applicable Government regulations governing such Restricted Rights as of such delivery.
Restricted Rights. Use, duplication or disclosure by or to the United States government may be subject to Restricted Rights as set forth in the Rights in Technical Data and Computer Software Clauses in DFARS 252.227-7013 (c)(1) and FAR 52.227-19(a)-(d) as applicable (or successor regulations thereto) and Evaluation Laboratory agrees to comply with all such Restricted Rights in connection with its use of any of the Licensed Works.
Restricted Rights. Use, duplication, or disclosure by the U.S. Government is subject to restrictions as set forth in subparagraph (c)(1) of the Commercial Computer Software-Restricted Rights clause at h, subparagraph (c)(1)(ii) of The Rights in Technical Data and Computer Software clause at 252.227-7013, or subparagraph (d) of the Commercial Computer Software--Licensing at NASA FAR supplement 16-52.227-86, or their equivalent, as applicable.

Restricted Rights. (i) The Government shall have restricted rights in noncommer- cial computer software required to be deliv- ered or otherwise provided to the Govern- ment under this contract that were devel- oped exclusively at private expense.
(ii) The Contractor, its subcontractors, or suppliers are not required to provide the Government additional rights in non- commercial computer software delivered or otherwise provided to the Government with restricted rights. However, if the Govern- ment desires to obtain additional rights in such software, the Contractor agrees to promptly enter into negotiations with the Contracting Officer to determine whether there are acceptable terms for transferring such rights. All noncommercial computer software in which the Contractor has xxxxx- xx the Government additional rights shall be listed or described in a license agreement made part of the contract (see paragraph (b)(4) of this clause). The license shall enu- merate the additional rights granted the Government.
(iii) The Contractor acknowledges that—
(A) Restricted rights computer software is authorized to be released or disclosed to cov- ered Government support contractors;
(B) The Contractor will be notified of such release or disclosure;
(C) The Contractor (or the party asserting restrictions, as identified in the restricted rights legend) may require each such covered Government support contractor to enter into a non-disclosure agreement directly with the Contractor (or the party asserting restric- tions) regarding the covered Government support contractor’s use of such software, or alternatively, that the Contractor (or party asserting restrictions) may waive in writing the requirement for a non-disclosure agree- ment; and
(D) Any such non-disclosure agreement shall address the restrictions on the covered Government support contractor’s use of the restricted rights software as set forth in the clause at 252.227–7025, Limitations on the Use or Disclosure of Government-Furnished In- formation Marked with Restrictive Legends. The non-disclosure agreement shall not in- clude any additional terms and conditions unless mutually agreed to by the parties to the non-disclosure agreement.
Restricted Rights. (1) The Govern- ment obtains restricted rights in non- commercial computer software, re- quired to be delivered or otherwise pro- vided to the Government under a con- tract, that was developed exclusively at private expense.
(2) Contractors are not required to provide the Government additional rights in computer software delivered or otherwise provided to the Govern- ment with restricted rights. When the Government has a need for additional rights, the Government must negotiate with the contractor to determine if there are acceptable terms for transfer- ring such rights. List or describe all software in which the contractor has granted the Government additional rights in a license agreement made part of the contract (see paragraph (d) of this subsection). The license shall enumerate the specific additional rights granted to the Government.
Restricted Rights. The following applies to all acquisitions of the Licensed Software and Documentation by or for the U.S. government or by any prime contractor or subcontractor under any contract, grant or other activity with the U.S. government. The Licensed Software and Documentation and services utilizing the Licensed Software and Documentation provided under this Agreement are “commercial items” as that term is defined at 48 C.F.R. 2.101 consisting of “commercial computer software” and “commercial computer software documentation” as such terms are used in 48 C.F.R. 12.212 and other applicable acquisition regulations and are provided to the U.S. Government only as a commercial item. Consistent with 48 C.F.R. 12.212 and 48 C.F.R. 227.7202, all U.S. Government users and licensees acquire the Licensed Software and its associated services and Documentation with only those rights and subject to the restrictions set forth in this Agreement. Notwithstanding the foregoing, the Licensed Software and its associated services and Documentation may not be acquired by the U.S. government pursuant to a contract incorporating clauses prescribed by FAR Subpart 27.4 or DFARS Subpart 227.4.
