Common use of Restricted Transfers of Swiss Personal Data Clause in Contracts

Restricted Transfers of Swiss Personal Data. Where a Restricted Transfer of Swiss Personal Data terminates in a jurisdiction that has been the subject of a valid adequacy decision, adopted by the competent Swiss authorities, that provides that the receiving jurisdiction ensures an adequate level of protection, no other transfer mechanism shall be necessary. In all other cases, Restricted Transfers of Swiss Personal Data shall be conducted pursuant to the SCCs, as they have been adapted for use by the Swiss Federal Data Protection and Information Commissioner (“FDPIC”). Where applicable, this DPA incorporates the SCCs by reference, and the Parties are deemed to have accepted and executed the SCCs in their entirety, including the associated annexes.
