Common use of Restriction on Acquisition of Facilities Clause in Contracts

Restriction on Acquisition of Facilities. Except as may be specifically provided in this purchase order, Seller shall not acquire facilities hereunder and Seller shall not direct charge to this Purchase Order the cost of any item of facilities or the alteration to a facility. For the purpose of this requirement, facilities means industrial property (other than material, special tooling, military property, and special test equipment) for production, maintenance, research, development or test, including real property and rights therein, buildings, structures, improvements, and plant equipment as defined in FAR Part 45.101 and 45.301 and DFARS 245.301.
