Common use of Restrictions on Activities of Capital Clause in Contracts

Restrictions on Activities of Capital. Capital shall not hold any material assets, become liable for any obligations or engage in any business activities; provided, that Capital may be a co-obligor of the Notes (including any additional Notes incurred pursuant to Section 4.9 hereof) pursuant to the terms of this Indenture and as contemplated by the Purchase Agreement, dated as of November 30, 2001, by and among the Issuers, the Subsidiary Guarantors and the Initial Purchaser and, as necessary, may engage in any activities directly related or necessary in connection therewith.
