Restrictions on Management Trustee’s Power. The Management Trustee shall comply with the applicable provisions of the Code in the manner necessary to effect the intention of the parties that the Trust at all times be classified as an investment trust under Treasury Regulation Section 301.7701-4(c) whereby a Holder is treated as a grantor under the grantor trust rules under Code Section 671, et. seq., and that the Trust be accorded such treatment until its revocation pursuant to Article X hereof. The Management Trustee agrees to take any action required by the Code and Treasury Regulations promulgated thereunder to maintain such status.
