Common use of Restrictions on Subsidiaries Clause in Contracts

Restrictions on Subsidiaries. Except for restrictions contained in this Agreement or any other agreement with respect to Indebtedness of Borrower permitted hereunder as in effect on the date hereof, there are no contractual or consensual restrictions on Borrower or any of its Subsidiaries which prohibit or otherwise restrict (a) the transfer of cash or other assets (i) between Borrower and any of its Subsidiaries or (ii) between any Subsidiaries of Borrower or (b) the ability of Borrower or any of its Subsidiaries to incur Indebtedness or grant security interests to Lender in the Collateral.

Restrictions on Subsidiaries. Except for restrictions contained in this Agreement or any other agreement with respect to Indebtedness of Borrower permitted hereunder as in effect on the date hereof, there are no contractual or consensual restrictions on Borrower or any of its Subsidiaries which prohibit or otherwise restrict (a) the transfer of cash or other assets (i) between Borrower and any of its Subsidiaries or (ii) between any Subsidiaries of Borrower or (b) the ability of Borrower or any of its Subsidiaries to incur Indebtedness or grant security interests to Agent or any Lender in the Collateral.

Restrictions on Subsidiaries. Except for restrictions contained in this Agreement or any other agreement with respect to Indebtedness of Borrower Borrowers permitted hereunder as in effect on the date hereof, there are no contractual or consensual restrictions on any Borrower or any Subsidiaries of its Subsidiaries any Borrower which prohibit or otherwise restrict (a) the transfer of cash or other assets (i) between any Borrower and any of its Subsidiaries or (ii) between any Subsidiaries of any Borrower or (b) the ability of any Borrower or any of its Subsidiaries to incur Indebtedness or grant security interests to Agent or any Lender in the Collateral.

Except for restrictions contained in this Loan Agreement or any other agreement with respect to Indebtedness of Borrower the Borrowers permitted hereunder as in effect on the date hereofhereunder, there are no contractual or consensual restrictions on Borrower the Borrowers or any of its their Subsidiaries which prohibit or otherwise restrict (a) the transfer of cash or other assets (i) between Borrower the Borrowers and any of its Subsidiaries their Subsidiaries; or (ii) between any Subsidiaries of Borrower the Borrowers; or (b) the ability of Borrower the Borrowers or any of its their Subsidiaries to incur Indebtedness or grant security interests to the Lender in the Collateral.
