Common use of Restrictive Covenant Violation Clause in Contracts

Restrictive Covenant Violation. If a Restrictive Covenant Violation occurs, then the purchase price per Unit will be the lesser of (A) Fair Market Value (measured as of the Repurchase Notice Date) and (B) Cost; and

Restrictive Covenant Violation. If a Restrictive Covenant Violation occurs, then the purchase price per Co-Investment Unit will be the lesser of (A) Fair Market Value (measured as of the Repurchase Notice Date) and (B) Cost; andor

Restrictive Covenant Violation. If a Restrictive Covenant Violation occurs, then the purchase price per Incentive Unit (whether a Vested Incentive Unit or an Unvested Incentive Unit) will be the lesser of (A) Fair Market Value (measured as of the Repurchase Notice Date) and (B) Cost; and

Restrictive Covenant Violation. If In the event of a Restrictive Covenant Violation occursViolation, then the purchase price per Unit will be the lesser of (A) Fair Market Value thereof (measured as of the Repurchase Notice Valuation Date) and (B) Cost; and;

Restrictive Covenant Violation. If a Restrictive Covenant Violation occurs, then the purchase price per Unit will be the lesser of (A1) Fair Market Value of the Issuer Equity (measured as of the Repurchase Notice Date) and (B2) CostCost of the Issuer Equity; and
