Restrictive Covenants by Optometrists. Under the Restrictive Covenant, to the extent then required by the Professional Business Manager, the non-Shareholder Professionals shall agree not to practice optometry and/or therapeutic optometry or provide Optical Services within a certain radius, as set forth in Exhibit 4.7A, of any Office location at which such non-Shareholder Professionals performed services on a regular basis for sixteen (16) or more hours per week or one thousand (1,000) hours during the last twelve (12) months of such Professionals' employment with the Practice. The Restrictive Covenant shall be effective for a period of one (1) year following termination of employment with the Practice and may be subject to a liquidated damages provision as authorized hereafter.
