Common use of Retention by Lessor Clause in Contracts

Retention by Lessor. If the Property is to be retained by Lessor on such date pursuant to Subparagraph 3.02(d), (i) the Residual Value Guaranty Amount, (ii) the Indemnity Amount, (iii) all unpaid Rent accrued through or due and payable on or prior to such date and (iv) all other amounts, if any, due and payable by Lessee under the Operative Documents on or prior to such date.

Retention by Lessor. If the Facility 2 Property is to be retained by Lessor on such date pursuant to Subparagraph 3.02(d), (iA) the Residual Value Guaranty Amount, (iiB) the Indemnity Amount, (iiiC) all unpaid Rent accrued through or due and payable on or prior to such date and (ivD) all other amounts, if any, due and payable by Lessee under the Operative Documents on or prior to such date.

If the Facility 3 Property is to be retained by Lessor on such date pursuant to Subparagraph 3.02(d), (iA) the Residual Value Guaranty Amount, (iiB) the Indemnity Amount, (iiiC) all unpaid Rent accrued through or due and payable on or prior to such date and (ivD) all other amounts, if any, due and payable by Lessee under the Operative Documents on or prior to such date.

If the Facility 1 Property is to be retained by Lessor on such date pursuant to Subparagraph 3.02(d), (iA) the Residual Value Guaranty Amount, (iiB) the Indemnity Amount, (iiiC) all unpaid Rent accrued through or due and payable on or prior to such date and (ivD) all other amounts, if any, due and payable by Lessee under the Operative Documents on or prior to such date.
