Common use of Retention of Concessionaire Clause in Contracts

Retention of Concessionaire. On or before the Term Commencement Date, StadCo shall engage, and at all times during the Term retain, a concessionaire (the “Concessionaire”) to operate the concession operations at the Stadium pursuant to a concessionaire agreement (a “Concessionaire Agreement”) and any Concessionaire must, at the time of entry into the Concessionaire Agreement, and at all times during the term of the Concessionaire Agreement, meet the requirements of a Qualified Concessionaire. In all instances, each Concessionaire Agreement shall (i) require the Concessionaire to comply with the terms of this Agreement as to the use and operation of the Premises and (ii) provide that the Authority shall be a third party beneficiary and permitted assignee thereof.‌
