Common use of Return of Copies Clause in Contracts

Return of Copies. If you cease to be involved in the tender processes for the Kaftarkhana of Shikhali Marble Parwan Project or are unsuccessful as a bidder for Parwan Project and we so request, you shall in relation this Project in which you have ceased to be involved return all Confidential Information supplied to you by us or by any person on our behalf and destroy or permanently erase all copies of Confidential Information made by you and use all reasonable endeavors to ensure that anyone to whom you have supplied any Confidential Information destroys or permanently erases such Confidential Information and any copies made by them. You shall provide written confirmation to us that such Confidential Information has been returned, destroyed or permanently erased, as applicable. Your obligation under this paragraph 5 apply save to the extent that you or the recipients of the Confidential Information are required to retain any such Confidential Information by any applicable law or by any competent judicial, governmental, supervisory, banking, taxation, regulatory or similar body, or stock exchange, having the force of law, or where the confidential Information has been disclosed under paragraph 2(b) of this Agreement at which point you shall notify us in writing explaining the reason behind the retention of such Confidential Information and the body requiring such retention of the Confidential Information.

Return of Copies. If you cease to be involved in the tender processes for the Kaftarkhana of Shikhali Marble Parwan Construction Materials Torkotal (Kandahar) Project or are unsuccessful as a bidder for Parwan Kandahar Project and we so request, you shall in relation to this Project in which you have ceased to be involved return all Confidential Information supplied to you by us or by any person on our behalf and destroy or permanently erase all copies of Confidential Information made by you and use all reasonable endeavors to ensure that anyone to whom you have supplied any Confidential Information destroys or permanently erases such Confidential Information and any copies made by them. You shall provide written confirmation to us that such Confidential Information has been returned, destroyed or permanently erased, as applicable. Your obligation under this paragraph 5 apply save to the extent that you or the recipients of the Confidential Information are required to retain any such Confidential Information by any applicable law or by any competent judicial, governmental, supervisory, banking, taxation, regulatory or similar body, or stock exchange, having the force of law, or where the confidential Information has been disclosed under paragraph 2(b) of this Agreement at which point you shall notify us in writing explaining the reason behind the retention of such Confidential Information and the body requiring such retention of the Confidential Information.

If you cease to be involved in the tender processes for the Kaftarkhana of Shikhali Marble Parwan Construction Materials (Kalafgan, Arabdara, Takhar) Project or are unsuccessful as a bidder for Parwan Takhar Project and we so request, you shall in relation to this Project in which you have ceased to be involved return all Confidential Information supplied to you by us or by any person on our behalf and destroy or permanently erase all copies of Confidential Information made by you and use all reasonable endeavors to ensure that anyone to whom you have supplied any Confidential Information destroys or permanently erases such Confidential Information and any copies made by them. You shall provide written confirmation to us that such Confidential Information has been returned, destroyed or permanently erased, as applicable. Your obligation under this paragraph 5 apply save to the extent that you or the recipients of the Confidential Information are required to retain any such Confidential Information by any applicable law or by any competent judicial, governmental, supervisory, banking, taxation, regulatory or similar body, or stock exchange, having the force of law, or where the confidential Information has been disclosed under paragraph 2(b) of this Agreement at which point you shall notify us in writing explaining the reason behind the retention of such Confidential Information and the body requiring such retention of the Confidential Information.

If you cease to be involved in the tender processes for the Kaftarkhana of Shikhali Marble Parwan Dasht Xxxx Xxxxxx Qol-e-khish Behsood Travertine Maidan Wardak Project or are unsuccessful as a bidder for Parwan Maidan Wardak Project and we so request, you shall in relation this Project in which you have ceased to be involved return all Confidential Information supplied to you by us or by any person on our behalf and destroy or permanently erase all copies of Confidential Information made by you and use all reasonable endeavors to ensure that anyone to whom you have supplied any Confidential Information destroys or permanently erases such Confidential Information and any copies made by them. You shall provide written confirmation to us that such Confidential Information has been returned, destroyed or permanently erased, as applicable. You shall provide written confirmation to us that such Confidential Information has been returned, destroyed or permanently erased, as applicable. Your obligation under this paragraph 5 apply save to the extent that you or the recipients of the Confidential Information are required to retain any such Confidential Information by any applicable law or by any competent judicial, governmental, supervisory, banking, taxation, regulatory or similar body, or stock exchange, having the force of law, or where the confidential Information has been disclosed under paragraph 2(b) of this Agreement at which point you shall notify us in writing explaining the reason behind the retention of such Confidential Information and the body requiring such retention of the Confidential Information.

You shall provide written confirmation to us that such Confidential Information has been returned, destroyed or permanently erased, as applicable. You shall provide written confirmation to us that such Confidential Information has been returned, destroyed or permanently erased, as applicable. Your obligation under this paragraph 5 apply save to the extent that you or the recipients of the Confidential Information are required to retain any such Confidential Information by any applicable law or by any competent judicial, governmental, supervisory, banking, taxation, regulatory or similar body, or stock exchange, having the force of law, or where the confidential Information has been disclosed under paragraph 2(b) of this Agreement at which point you shall notify us in writing explaining the reason behind the retention of such Confidential Information and the body requiring such retention of the Confidential Information.

You shall provide written confirmation to us that such Confidential Information has been returned, destroyed or permanently erased, as applicable. Your obligation under this paragraph 5 apply save to the extent that you or the recipients of the Confidential Information are required to retain any such Confidential Information by any applicable law or by any competent judicial, governmental, supervisory, banking, taxation, regulatory or similar body, or stock exchange, having the force of law, or where the confidential Information has been disclosed under paragraph 2(b) of this Agreement at which point you shall notify us in writing explaining the reason behind the retention of such Confidential Information and the body requiring such retention of the Confidential Information.

You shall provide written confirmation to us that such Confidential Information has been returned, destroyed or permanently erased, as applicable. Your obligation under this paragraph 5 apply save to the extent that you or the recipients of the Confidential Information are required to retain any such Confidential Information by any applicable law or by any competent judicial, governmental, supervisory, banking, taxation, regulatory or similar body, or stock exchange, having the force of law, or where the confidential Information has been disclosed under paragraph 2(b) of this Agreement at which point you shall notify us in writing explaining the reason behind the retention of such Confidential Information and the body requiring such retention of the Confidential Information.

You shall provide written confirmation to us that such Confidential Information has been returned, destroyed or permanently erased, as applicable. Your obligation under this paragraph 5 apply save to the extent that you or the recipients of the Confidential Information are required to retain any such Confidential Information by any applicable law or by any competent judicial, governmental, supervisory, banking, taxation, regulatory or similar body, or stock exchange, having the force of law, or where the confidential Information has been disclosed under paragraph 2(b) of this Agreement at which point you shall notify us in writing explaining the reason behind the retention of such Confidential Information and the body requiring such retention of the Confidential Information.

You shall provide written confirmation to us that such Confidential Information has been returned, destroyed or permanently erased, as applicable. Your obligation under this paragraph 5 apply save to the extent that you or the recipients of the Confidential Information are required to retain any such Confidential Information by any applicable law or by any competent judicial, governmental, supervisory, banking, taxation, regulatory or similar body, or stock exchange, having the force of law, or where the confidential Information has been disclosed under paragraph 2(b) of this Agreement at which point you shall notify us in writing explaining the reason behind the retention of such Confidential Information and the body requiring such retention of the Confidential Information.

You shall provide written confirmation to us that such Confidential Information has been returned, destroyed or permanently erased, as applicable. Your obligation under this paragraph 5 apply save to the extent that you or the recipients of the Confidential Information are required to retain any such Confidential Information by any applicable law or by any competent judicial, governmental, supervisory, banking, taxation, regulatory or similar body, or stock exchange, having the force of law, or where the confidential Information has been disclosed under paragraph 2(b) of this Agreement at which point you shall notify us in writing explaining the reason behind the retention of such Confidential Information and the body requiring such retention of the Confidential Information.

You shall provide written confirmation to us that such Confidential Information has been returned, destroyed or permanently erased, as applicable. Your obligation under this paragraph 5 apply save to the extent that you or the recipients of the Confidential Information are required to retain any such Confidential Information by any applicable law or by any competent judicial, governmental, supervisory, banking, taxation, regulatory or similar body, or stock exchange, having the force of law, or where the confidential Information has been disclosed under paragraph 2(b) of this Agreement at which point you shall notify us in writing explaining the reason behind the retention of such Confidential Information and the body requiring such retention of the Confidential Information.

You shall provide written confirmation to us that such Confidential Information has been returned, destroyed or permanently erased, as applicable. Your obligation under this paragraph 5 apply save to the extent that you or the recipients of the Confidential Information are required to retain any such Confidential Information by any applicable law or by any competent judicial, governmental, supervisory, banking, taxation, regulatory or similar body, or stock exchange, having the force of law, or where the confidential Information has been disclosed under paragraph 2(b) of this Agreement at which point you shall notify us in writing explaining the reason behind the retention of such Confidential Information and the body requiring such retention of the Confidential Information.

If you cease to be involved in the tender processes for the Kaftarkhana of Shikhali Marble Parwan Project Nangarhar and Kunar province or are unsuccessful as a bidder for Parwan Marble Project and we so request, you shall in relation this Project in which you have ceased to be involved return all Confidential Information supplied to you by us or by any person on our behalf and destroy or permanently erase all copies of Confidential Information made by you and use all reasonable endeavors to ensure that anyone to whom you have supplied any Confidential Information destroys or permanently erases such Confidential Information and any copies made by them. You shall provide written confirmation to us that such Confidential Information has been returned, destroyed or permanently erased, as applicable. Your obligation under this paragraph 5 apply save to the extent that you or the recipients of the Confidential Information are required to retain any such Confidential Information by any applicable law or by any competent judicial, governmental, supervisory, banking, taxation, regulatory or similar body, or stock exchange, having the force of law, or where the confidential Information has been disclosed under paragraph 2(b) of this Agreement at which point you shall notify us in writing explaining the reason behind the retention of such Confidential Information and the body requiring such retention of the Confidential Information.

Return of Copies. If we do not enter into the Acquisition and you cease to be involved so request in the tender processes for the Kaftarkhana of Shikhali Marble Parwan Project or are unsuccessful as a bidder for Parwan Project and writing, we so request, you shall in relation this Project in which you have ceased to be involved return all Confidential Information supplied by you to you by us or by any person on our behalf and destroy or permanently erase (to the extent technically practicable) all copies of Confidential Information made by you us and use all our reasonable endeavors endeavours to ensure that anyone to whom you we have supplied any Confidential Information destroys or permanently erases (to the extent technically practicable) such Confidential Information and any copies made by them. You shall provide written confirmation to us that such Confidential Information has been returned, destroyed or permanently erased, as applicable. Your obligation under this paragraph 5 apply in each case save to the extent that you we or the recipients of the Confidential Information are required to retain any such Confidential Information by any applicable law law, rule or regulation or by any competent judicial, governmental, supervisory, banking, taxation, supervisory or regulatory body or similar body, or stock exchange, having the force of lawin accordance with internal policy, or where the confidential Confidential Information has been disclosed under sub-paragraph (iii) of paragraph 2(b) of this Agreement at which point you shall notify us in writing explaining the reason behind the retention of such Confidential Information and the body requiring such retention of the Confidential Informationabove. 203 CONFIDENTIAL TREATMENT HAS BEEN REQUESTED FOR PORTIONS OF THIS EXHIBIT.
