Common use of Return of Payments Clause in Contracts

Return of Payments. (i) If the Administrative Agent pays an amount to a Lender under this Agreement in the belief or expectation that a related payment has been or will be received by the Administrative Agent from the Borrower and such related payment is not received by the Administrative Agent, then the Administrative Agent will be entitled to recover such amount from such Lender on demand without set-off, counterclaim or deduction of any kind.

Return of Payments. (i) If the Administrative Agent pays an amount to a Lender under this Agreement in the belief or expectation that a related payment has been or will be received by the Administrative Agent from the Borrower and such related payment is not received by the Administrative Agent, then the Administrative Agent will be entitled to recover such amount from such Lender on demand without set-offsetoff, counterclaim or deduction of any kind, together with interest accruing on a daily basis at the Federal Funds Rate.

Return of Payments. (i1) If the Administrative Agent pays an amount to a Lender under this Agreement in the belief or expectation that a related payment has been or will be received by the Administrative Agent from the Borrower and such related payment is not received by the Administrative Agent, then the Administrative Agent will be entitled to recover such amount from such Lender on demand without set-off, counterclaim or deduction of any kind.

(i) If the Administrative Agent pays an amount to a Lender Note Purchaser under this Agreement in the belief or expectation that a related payment has been or will be received by the Administrative Agent from the Borrower Issuer and such related payment is not received by the Administrative Agent, then the Administrative Agent will be entitled to recover such amount from such Lender on demand Note Purchaser without set-off, counterclaim or deduction of any kind.

Return of Payments. (i) If the Administrative Agent pays an amount to a Lender under this Agreement in the belief or expectation that a related payment has been or will be received by the Administrative Agent from the Borrower and such related payment is not received by the Administrative Agent, then the Administrative Agent will be entitled to recover such amount (including interest accruing on such amount at the rate otherwise applicable to such Obligation) from such Lender on demand without set-offsetoff, counterclaim or deduction of any kind.

(i) If the Administrative Agent pays an amount to a Lender under this Agreement in the belief or expectation that a related payment has been or will be received by the Credit and Security Agreement 61 Administrative Agent from the a Borrower and such related payment is not received by the Administrative Agent, then the Administrative Agent will be entitled to recover such amount from such Lender on demand without set-offsetoff, counterclaim or deduction of any kind, together with interest accruing on a daily basis at the Federal Funds Rate.

(i) If the Administrative Agent or a Group Agent pays an amount to a Lender under this Agreement in the belief or expectation that a related payment has been or will be received by the Administrative Agent or such Group Agent, as applicable, from the Borrower and such related payment is not received by the Administrative Agent or such Group Agent, as applicable, then the Administrative Agent or such Group Agent, as applicable, will be entitled to recover such amount from such Lender on demand without set-off, counterclaim or deduction of any kind.

Return of Payments. (i) If the Administrative Agent pays an amount to a Lender Note Purchaser under this Agreement in the belief or expectation that a related payment has been or will be received by the Administrative Agent from the Borrower Issuer and such related payment is not received by the 106 Administrative Agent, then the Administrative Agent will be entitled to recover such amount from such Lender on demand Note Purchaser without set-off, counterclaim or deduction of any kind.

(i1) If the Administrative Agent pays an amount to a Lender under this Agreement in the belief or expectation that a related payment has been or will be received by the Administrative Agent from the a Borrower and such related payment is not received by the Administrative Agent, then the Administrative Agent will be entitled to recover such amount from such Lender on demand without set-off, counterclaim or deduction of any kind.

(i) If the Administrative Agent pays an amount to a Lender under this Agreement in the belief or expectation that a related payment has been or will be received by the Administrative Agent from the a Borrower and such related payment is not received by the Administrative Agent, then the Administrative Agent will be entitled to recover such Credit and Security Agreement 45 amount from such Lender on demand without set-offsetoff, counterclaim or deduction of any kind, together with interest accruing on a daily basis at the Federal Funds Rate.

(ia) If the Administrative Agent pays an amount to a Lender under this Agreement in the belief or expectation that a related payment has been or will be received by the Administrative Agent from the Borrower Borrowers and such related payment is not received by the Administrative Agent, then the Administrative Agent will be entitled to recover such amount from such Lender on demand without set-offsetoff, counterclaim counterclaim, defense or deduction of any kind.
