Common use of Return of Subscription Equipment Clause in Contracts

Return of Subscription Equipment. You agree that in the event your Bark Wireless Services are terminated, you will return all Subscription Phone(s) to Bark within ten (10) days of termination, unless otherwise instructed in writing by a Bark representative. If you have multiple users on your Wireless Account and you terminate one of your Users, you must promptly return the Subscription Phone used by such User. Such Subscription Phone must be returned within ten (10) days of notifying Bark of your decision to terminate such User from your Wireless Account, unless otherwise instructed in writing by a Bark representative. The returned Subscription Phone(s) must be in good condition and without any encumbrances, except for ordinary wear and tear resulting from proper use. Scratches, dents, cracks, water damage and/or similar damage will not be considered “ordinary wear and tear”. Upon your notification to Bark that you intend to terminate your Wireless Account or one or more Users on your Wireless Account in a manner requiring return of Subscription Phone(s), Bark will issue you a return shipping label to use for the return of your Subscription Phone. Bark will inspect the Subscription Phone(s) for damage upon receipt. This provision shall survive the termination or expiration of this Agreement. If the returned Subscription Phone is damaged (a “Damaged Subscription Phone”), we will charge the Replacement Cost of the Subscription Phone to your Wireless Account (the foregoing, as applicable, the “Damage Fee”). You further authorize Bark to charge any applicable Damage Fee to the Payment Mechanism on file with Bark.

You further authorize Bark to charge any applicable Damage Fee to the Payment Mechanism on file with Bark.
